Website terms
Terms & Conditions
Effective date: September 10, 2026
These Terms & Conditions ("Terms") govern your access to and use of www.danieltrader.app and its portfolio, document viewers, contact form, and related content (collectively, the "Site"). The Site is operated by Daniel Trader, doing business as Daniel Trader Creative ("Daniel Trader Creative," "I," "me," or "my"). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.
1. Purpose of the Site
The Site presents selected creative work, professional experience, capabilities, press coverage, and a way to inquire about services. Site content is provided for general informational and portfolio purposes. Availability, scope, pricing, deadlines, deliverables, ownership, licensing, payment, confidentiality, cancellation, and other terms for any engagement will be established only in a separate written proposal, statement of work, contract, or other agreement accepted by the relevant parties.
2. No client relationship or obligation
Sending an inquiry does not create a client, agency, fiduciary, employment, partnership, joint-venture, or other professional relationship. I am not obligated to accept, respond to, or keep open any inquiry. Do not treat a preliminary conversation, estimate, or Site statement as a binding commitment unless it is included in a separate written agreement accepted by both parties.
3. Intellectual property
Except where otherwise identified, the Site's original design, layout, text, illustrations, graphics, motion, code, compilations, and presentation are owned by or licensed to Daniel Trader Creative and are protected by copyright, trademark, and other laws. You may view the Site and make a temporary copy through normal browser operation for personal, noncommercial evaluation of my services.
You may not, without prior written permission:
- copy, reproduce, republish, distribute, publicly display, sell, license, or create derivative works from Site content;
- use portfolio work, screenshots, designs, or assets as templates, stock material, training data, or source material for commercial or machine-learning purposes;
- remove credits, copyright notices, trademarks, watermarks, or rights-management information;
- misrepresent Site content as your own or imply an affiliation or endorsement that does not exist; or
- use automated tools to scrape, extract, index beyond ordinary search-engine activity, or systematically download Site content.
Client names, logos, trademarks, products, photographs, and campaign materials shown in the portfolio may belong to their respective owners. They are displayed to identify projects and illustrate work performed. Their appearance does not transfer any ownership to Daniel Trader Creative or grant you a license to use them.
4. Portfolio context and confidentiality
The Site contains selected examples and summaries rather than complete project records. Results, responsibilities, and context vary by project, client, time period, market, collaborators, budget, and other circumstances. Unless expressly stated, nothing on the Site should be understood as a promise that another project will achieve the same result.
Do not submit confidential, proprietary, embargoed, regulated, or legally privileged material through the general contact form. Confidentiality obligations arise only through an applicable written agreement. If you believe material on the Site should not be displayed or requires updated attribution, contact me with enough detail to review the request.
5. Acceptable use
You agree not to:
- use the Site for unlawful, fraudulent, harassing, abusive, defamatory, or infringing purposes;
- submit malicious code, spam, deceptive inquiries, or content that violates another person's rights;
- interfere with the Site's operation, security, servers, or access controls;
- probe, scan, test, bypass, or exploit a vulnerability or rate limit without written authorization;
- impersonate another person or provide materially false contact information;
- collect information about other visitors; or
- use the Site in a way that imposes an unreasonable load or disrupts another person's use.
I may restrict access, block submissions, preserve relevant evidence, or report conduct when reasonably necessary to protect the Site, users, rights holders, or others.
6. Your submissions
You retain ownership of content you submit. You grant Daniel Trader Creative a limited, nonexclusive permission to receive, copy, store, transmit, review, and use that content only as reasonably necessary to respond to your inquiry, evaluate or provide requested services, operate and secure the Site, comply with law, and enforce these Terms. You represent that you have the right to submit the content and that doing so does not violate law, confidentiality duties, or third-party rights.
7. Third-party links and services
The Site may link to or rely on third-party sites and services, including client sites, publications, social platforms, Vercel, and Resend. Links are provided for context or convenience and do not constitute control, sponsorship, or endorsement unless expressly stated. Third parties operate under their own terms and policies. I am not responsible for their content, availability, security, or practices.
8. Accuracy and availability
I aim to present accurate, useful information, but the Site may contain typographical errors, estimates, dated material, incomplete descriptions, or technical issues. I may revise or remove content, features, links, or access at any time. The Site may be unavailable because of maintenance, provider outages, security events, or circumstances beyond my control.
9. Disclaimers
To the fullest extent permitted by law, the Site is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory. This includes implied warranties of merchantability, fitness for a particular purpose, title, noninfringement, accuracy, availability, and security. I do not warrant that the Site will be uninterrupted, error-free, free of harmful components, or suitable for your particular needs. Nothing on the Site is legal, financial, accounting, employment, or other regulated professional advice.
10. Limitation of liability
To the fullest extent permitted by law, Daniel Trader Creative and Daniel Trader will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, business opportunities, or use, arising from or related to the Site, third-party services, or these Terms, even if advised that such damages are possible.
To the fullest extent permitted by law, total liability for all claims arising from or related to the Site or these Terms will not exceed the greater of the amount you paid specifically to access the Site during the twelve months before the event giving rise to the claim or US $100. This limitation does not apply where liability cannot legally be excluded or limited, including any rights you may have under applicable consumer-protection law.
11. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Daniel Trader and Daniel Trader Creative from third-party claims, losses, liabilities, damages, judgments, and reasonable costs arising from your unlawful misuse of the Site, your submitted content, or your material violation of these Terms or another person's rights. This section does not require indemnification for conduct attributable solely to Daniel Trader Creative and does not limit rights that cannot be waived under applicable law.
12. Privacy
The Privacy Policy explains how personal information is handled and is incorporated into these Terms by reference.
13. Governing law and disputes
These Terms are governed by the laws of the State of Maryland, without regard to conflict-of-law principles. Subject to any nonwaivable right to bring a claim elsewhere, disputes arising from the Site or these Terms will be brought in a state or federal court with proper jurisdiction in Maryland, and the parties consent to that jurisdiction and venue. Before filing a claim, you and Daniel Trader Creative agree to make a good-faith effort to resolve the issue informally by written notice and at least 30 days for a response. Nothing here prevents either party from seeking urgent injunctive or equitable relief where appropriate.
14. Changes to these Terms
I may update these Terms to reflect Site, business, provider, or legal changes. Updated Terms will be posted here with a revised effective date. Changes apply prospectively when posted unless law requires a different process. Your continued use after the effective date constitutes acceptance of the revised Terms.
15. General provisions
If a provision is found unenforceable, it will be enforced to the greatest extent permitted and the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver. You may not assign your rights or obligations under these Terms without prior written consent. These Terms and the Privacy Policy are the entire agreement concerning use of the Site, but they do not replace a separately executed client-services agreement.
